Responsibilities, Terms, & Conditions

RESPONSIBILITY:

The responsibility of Oahu Swim with Dolphins Tours and Tickets / Dolphin World, Keys Adventure Tours, Inc. and its agents is limited. Dolphin World, Keys Adventure Tours, Inc. acts solely as an agent for clients concerning travel or activities booked. Dolphin World, Keys Adventure Tours, Inc. assumes no liability for any injury, damage, loss, accident, delay, or irregularity that may occur due to defects, acts of God, war, fire, machinery breakdowns, riots, strikes, or any causes beyond the control of Dolphin World / Keys Adventure Tours, Inc.

All tour services, including activity times, transportation, and lodging, are provided by independent contractors (suppliers) and do not operate on behalf of Dolphin World / Keys Adventure Tours, Inc. By accepting these tour arrangements, you consent to the above terms. Dolphin World / Keys Adventure Tours, Inc. is not liable or responsible for any acts, errors, omissions, inconveniences, losses, damages, injuries, or deaths resulting from tour arrangements.

RESERVATIONS AND PAYMENTS:

All reservations must be paid in full using one of the following payment methods: Credit Card, MasterCard, Visa, American Express, Discover, PayPal, or a US Money Order/Personal US Bank Check. If you choose to pay by US Money Order or Personal US Bank Check, the final payment must be made at least 30 days prior to the departure date or activity date. For reservations made within 30 days of travel, full payment by Credit Card is required at the time of booking.

Dolphin World / Keys Adventure Tours, Inc. cannot guarantee reservations that are not paid on time. The prices for all swim with the dolphins programs and workshops include the activity price and tax.

CANCELLATION POLICY:

All cancellations must be submitted in writing to Dolphin World / Keys Adventure Tours, Inc. via email or regular mail.

For cancellations made more than 30 days before the activity date, a 10% service charge will apply per person. For cancellations made within 29 to 15 days before the activity date, a 50% service charge will apply per person. If cancellations occur within 14 to 8 days prior to the activity date, a 75% service charge will apply per person.

If you need to cancel within 8 days of your reservation date, you may change your reservation to a gift certificate. This option incurs only a change fee, and the gift certificate will be valid for one year from the date it is issued.

Please note that no refunds will be issued to participants who cancel within the 7 days prior to the activity, do not show up, or arrive late for scheduled programs.

CHANGES:

Once a reservation is made, changing the scheduled program date is subject to availability. Any acceptable changes to existing reservations will incur a fee of $25.00 per person.

 

ACTIVITIES:

Dolphin World / Keys Adventure Tours operates as an agent and does not assume liability for nonperformance by the dolphins, trainers, or program features. The company will not be responsible for the loss or damage to unused portions of tours. Any issues, problems, or complaints related to the dolphin facility or the performance of dolphin programs must be addressed by the manager on duty at the facility on the day of your program. Once you leave the dolphin facility, neither Key Adventure Tours nor the dolphin facility can issue compensation.

Trained dolphin activities will occur rain or shine. All participants must check in at least 15 minutes before the scheduled activity time. Any missed activity times due to late check-ins or weather-related issues will be handled on a case-by-case basis by each activity provider and are not the responsibility of Dolphin World / Keys Adventure Tours, Inc. Once the activity begins, no refunds will be issued for any reason. Additionally, no cash refunds will be provided for rain checks received at any facility or outfitter.

Rain does not constitute a cancellation of activity unless the facility or outfitter officially closes. If a scheduled activity cannot be provided, or if there are changes in the itinerary due to reasons beyond the control of any facility or outfitter, Dolphin World / Keys Adventure Tours reserves the right to offer either a fair-value refund or a gift certificate valid for one year from the date of the missed activity.

Dolphin World / Keys Adventure Tours, Inc. will not be responsible for lost or cancelled activity times resulting from flight delays, acts of war, or acts of God. All activity participants are required to wear proper attire, which may include swimwear, outdoor footwear, and towels.

 

NO REFUNDS FOR UNUSED SERVICES:

Refunds or allowances will not be provided for transportation, accommodations, activities, services, or any other aspects of the trip that are not utilized on or after the tour departure date.

 

INSURANCE:

Passengers are strongly encouraged to secure insurance for their protection. We offer a 100% refund option, as well as optional cancellation, accident, health, and baggage insurance to safeguard tour participants against unexpected situations.
